End User Licence Agreement
This agreement is between you — a student, instructor or administrator — and Immersive Engineering, Inc., and governs your use of the immerse2learn.com platform. By accessing or using the Service, you agree to it.
1. Licence grant
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for educational purposes — including school programs, apprenticeships, and commercial or industrial training — strictly in accordance with this agreement and your organization’s Customer Agreement.
2. User types
- Student: completes courses.
- Instructor or administrator: manages classes and enrolments.
3. Restrictions
You may not:
- Sell, rent, lease, sublicense or commercially exploit the Service or access codes, except as expressly permitted by your organization’s Customer Agreement
- Share login credentials or allow unauthorized access
- Reverse engineer, modify, or create derivative works of the Service
- Post any content or use electronic communication features — the Service does not provide these
- Use the Service for any unlawful purpose, or to compete with us
High School STEM users must be currently enrolled high school students in an approved program.
3.1 Safety acknowledgement
You acknowledge that the Service provides instructional content concerning machine tools and manufacturing equipment that can cause serious injury or death if applied improperly.
You agree that you will not apply any program, setup, blueprint or procedure from the Service to physical equipment except under the direct supervision of a qualified instructor or subject matter expert, and only after the program or setup has been independently verified on that equipment by qualified personnel.
Parameters shown in the curriculum are illustrative and specific to the example equipment and setup shown, and may be unsafe on other equipment. The Service is not a substitute for hands-on training, supervision, or the operating and safety documentation supplied with your equipment.
4. Intellectual property
The Service, all courses, content and downloadable resources are owned exclusively by us.
5. Data ownership and privacy
You own your personal data. Consistent with our Privacy Policy, the Service collects only minimal student data — first and last name or identifier, email for password recovery, and password — and does not collect sensitive information such as birth dates, Social Security numbers, student IDs, transcripts, addresses or phone numbers. The Service contains no posting or electronic communication features.
As between the parties, the educational institution or organization is the data controller of education records and student data under FERPA. The Company acts solely as a data processor, and processes such data only as necessary to deliver the Service and in accordance with the institution’s instructions.
6. Term and termination
This agreement remains in effect while you have access. We may suspend or terminate access for violation of this agreement or the Customer Agreement. Upon termination, stop using the Service and delete any downloaded resources, except those retained for legitimate educational records.
7. Warranties and disclaimers
The Service is provided “as is”. We disclaim all warranties, express or implied, to the maximum extent permitted by law. Subject to section 10 below.
8. Limitation of liability
Our total liability shall not exceed the amount paid for the renewal. We are not liable for indirect, consequential or incidental damages. Subject to section 10 below.
9. Governing law
This agreement is governed by the laws of the State of Michigan. Venue is in the courts of Oakland County, Michigan. Subject to section 10 below.
10. Public educational institutions and government entities
This agreement is intended to comply with all applicable federal, state and local laws governing public educational institutions and government entities. In the event of any conflict between this agreement and any mandatory law, regulation or required governmental addendum, the applicable law, regulation or addendum shall control solely for that customer.
Any provision in this agreement that is prohibited or unenforceable for a public educational institution shall be automatically deemed modified or deleted to the minimum extent necessary to comply, while preserving the intent of the parties to the greatest extent possible. The Company will work in good faith with the Customer to accommodate any lawful requirements.
Acceptance
By accessing or using the Service, you agree to this agreement.
